Yes sent commerical lease at the advise of ResidHotel and got acknowledgement but they only deducted the tax dhabitation tax of €995. I will take bertrand up on his offer because this whole french thing is beginning to get me down finding it very difficult. I do appreciate everyone's help and advise and feel the forum has been great support.

In France there are two different taxes: one is the property tax (foncièr) and the other is tax d'habitation. You are not to pay the taxe d'habitation which includes the television as you are leased to a managment company (RH). However, you are obliged to pay the property taxes minus the gargbage tax (ordures menagers) which you are to send to RH for them to refund to you. In France, these property taxes are normally due 15 October and the French have a policy that late charge is 10%. You might try to find a kind soul at the tax office related to the location of your apartment that will help straighten it out. I suggest that you get in touch with others from your residence who will help you to understand the process. Good Luck!!

Dear Miz,

It is bit more complicated: the "taxe d"habitation" is due is the lease says that you can enjoy the property some weeks. If it is said that you will pay for this weeks with a discount of 25% max, tax office can relieve the tax but it is far from automatic. Regarding the TV it is even more complicated: who bought the TV?? ResidHotel is very clever here as now TV are purchased by RH, paid by owners and deducted from a rental quarter so the TV tax is due by owner... however this tax cannot be due if you don't pay the "taxe d"habitation".

Dear Bertarnd,
In the lease that we have with Residhotel (LMNP) the taxe d'habitation is covered by Residhotel and we pay the fonciere. The lease states an annual rent with part of it being numeraire and part "en nature".We all had several different options as to the formula of occupation ranging form zero to 8 weeks at various periods of the year with corresponding numerary rents. We submit copies of the receipts of rent (Residhotel) and copies of personal occupation (Residhotel)as well as copies of the tax fonciere to the company that does the tax declarations. We also send a copy of the tax fonciere to Residhotel for refund of the taxe ordures menageres. It is probable that different residences have different leases but this is how ours works but in our case we don't even receive the taxe d'habitation. It is directly sent to Residhotel.

Dear Miz,

Each lease contract is different as it is contractual. then each tax office may have different view. At last each tax controller has a personal approach of the problem. I agree it is complicated.

Normally the company who does your tax form should claim for any tax relief, I suppose it is G...

RH does not receive your taxe d'habitation but is taxed on assets (taxe professionnelle) and it is because RH is taxed with TP that you do not receive your TH.
