Domaine de Figuiere-swimming pool problem

Has anyone fully understood the recent problem at this St Maxime Domaine involving the swimming pool and how this affected the quarterly rental payment? Also has anyone has any luck extracting an english translation of communications from Gerimmo? I'm concerned to find after years of paying that Taxe d'habitation does not need to be paid..is this the case if the property is furnished with one of the furniture packs originally offered?

It would be great to hear from anyone else who owns a property on this development.

Hi Nicola,


Myself and Chris also own appartments at this development.According to Chris,his french is much better than mine,Eurogroup are unhappy with the legal action being taken by Gerimmo regards the swimming pool repairs.He says that they have made no specific mention of non-payment of rent but they sent the email on the rent due date,and they have subsquently not paid the rent.


I have emailed myriam darthial @ eurogroup-vavances.com for a list of owners names and addresses.As yet have had no reply.


Noel has posted on this forum(24/4/08 Domaine des Fontenelles/Green Marines) saying that your are entitled to this imformation from your co-op.He has succeeded with his.


I cant find an email address for Gerimmo,so if anyone knows it,can you please post?.


What is your surname?


Taxe D'habitation is paid by the tennant,in our case Eurogroup.I dont the furniture package has any relevence.


I also made the error of paying tax D'habitation for the first year and it it has taken me 2 years to claim it back.

My brother and I bought the apartment together (it is his name Stewart Mechem, that appears on all the paperwork that gets circulated about meetings.


After numerous emails and telephone calls to Myriam Darthial our rent did eventually get paid on 21/4. We were told that Eurogroup required an email from us to them complaining about the non payment of rent and our unhappiness with the swimming pool situation - then she said we would receive our rent - which we did. However the rent has been paid but for some reason the TVA has been deducted so we were just over 100 euros shortchanged. Neither of us speak french well so everything is a challenge and discovering the reason for the deduction is the next battle!


We bought the apartment in 2004 and it was only upon discovering this forum the other evening that alerted us to the tax d'habitation situation. Do I understand correctly (having read other discussions), that we should not be paying the redevance audiovisuelle either? If so we now have a lengthy battle to reclaim years of payments!!


All a learning curve! Thank you very much for getting back to me.

Hi nicola,


The audiovisuelle is also Eurogroup responsibility.They hire the T.V. out not you.(remember you don't,as an owner,have to pay for the T.V. when you are staying there.)


I am happy to hear that they have paid your rent.I get my bank statement next week and will be looking carefully at it.Cant think why they would deduct the T.V.A..Although the T.V.A. is not yours and has to be paid back to the French tax man via your accountant.

Hi Nicola,

Just to agree with John, Taxe d'Habitation (and the TV license for that matter)are not payable by us even though of course we keep getting asked to pay them! Taxe Fonciere is our responsibility (although only in part over the initial period).

With regards, the swimming pool, I believe it will be fixed by the end of May. There is a legal action going on between the syndic and the developers for negligence in building it. They in turn are blaming the maintenance regime and hence Eurogroup have been brought into the action. This has led them to incurring costs and appeared to be withholding our rent - although they have paid most, if not all of what is due to us.

We of course have already paid for the swimming pool repair collectively and are relying on the legal action being succesful to get our money back.

I'm not sure these documents from Gerimmo will ever be in English as we are a minority at the syndic, most owners are French.

I have sent you my e-mail address by the messenger system if you want to keep in touch. This may the only way to keep the rent coming in the next time Eurogroup decide not to pay us!.

I don't have an email address for Gerimmo but I have spoken to a helpful lady named Madame Telleboue at Oralia/Gerimmo - she seems to be available after midday on the following number 0033472831099.


Thank you for explaining the swimming pool issue and for alerting us to the various taxes we've been paying unnecessarily!


Shall let you know how we get on with a refund. I understand that we should send back the tax requests by registered post with a copy of our bail commercial to the tax office and also a copy to the management company asking that they arrange payment of their bill. If there is any further advice on this subject, we would be grateful.

What do you mean Nicola by "multirisques habitation deducted from your rental income by the managment company"? Do they pay your rent minus a lump sum for the insurance?


I am not sure that's legal!

Yes, that's correct, Eurogroup make a deduction but we also receive correspondence from a company called Dedeyan Legendre/AGF www.asdedeyan.fr who request payments for multirisques habitation-they contacted us after we bought the apartment confirming our apartment address and the contract number for our multirisques habitation.

Thanks for the answer. According to the law you are not obliged to contract an insurance for your flat. However the managment company is obliged to have one for each property and for the residence in a whole. Your syndic should also have one. Do you have a copy of those 2 insurances? Every year your managment company should send you a copy of it. If not, please ask for it.


Have you ever received your contract? Have you received the general conditions? What is in this multirisque insurance? what does it cover (your flat or the property as a whole)? What do you pay for?


Do you have a "protection juridique" or "responsabilite civile" in this insurance? If yes, it will be useful in case of problems with your managment company ... as the lawyers' costs should be refund by the insurance. Otherwise it is useless.


Usually if the owner of the property wants to insure this type of flat, there is a special insurance in France for that kind of property... as you do not live there and you rent it out, and the "tenant" sub let it. It is a kind of "buy to let" insurance. Ask for more details to your managment company and the insurance company.


If nobody says nothing, you might pay for something you should not. Same thing for the TV.
