experiences with leasebacks

I did promise you that I would give good feedback about leaseback scheme as well as bad news. So here I am again to tell you that I am receiving a good service from the management company Gestrim Campus who pay the correct amounts for the rents on the due dates.I have had no problems with them at all.

I am still ,however, awaiting news of the TVA refund

I have just been reading some of Anna's comments about
the leaseback scheme. I myself had huge difficulty securing a
refund of the VAT on an investment in Annecy in the 'Le Birdie'
development project. I was with the OACI , an accountancy firm who were
overpriced and totally incompetent. It took me about one year to secure
my VAT as a result of them missing deadlines and losing my file. I am
no longer with this crowd.

I also have an on-going nightmare with the management company of 'Le Birdie'. LVR Vacances never pay the rent on time.
Indeed I am still awaiting rent from the end of June. This has been the
scenario since the very beginning og the current leaseback. I am
constantly ringing them, sending e-mails etc and the lies and deceit
continue to flow. They frequently get my account details wrong, never
return my calls and lie as if there were no tomorrow. ' The rent
has been sent.....Have you not received it.....We will send you a copy
of the transfer (doesn't arrive). I am sick to death of this crowd and
wonder if there are any other people out there with similar experiences
and if so what have you done to sort things out. My patience is wearing
thin and I am totally frustrated. I wouldn't mind but I speak fluent
French so there is no communication problems. I have another leaseback
in the Apls and have no problems at all with this one.

I posted this several times under the thread IMOINVEST but it kept on disappearing so I am sorry if it is now on the wrong thread. However, you will see from my previous correspondence on the other threads that I had suspected that IMOINVEST had not progressed the application for TVA on our behalf. I therefore asked for confirmation in writing that this had been done and asked for a copy of the application to the French Tax Office along with details of the Accountant whom they had appointed on our behalf as we had misplaced his details. They did not reply to my request so a letter was sent by our solicitor who is also a French consulate. To date we still have not as requested received a response to this letter confirming the application had been made nor a copy of the application nor details of the accountant who was dealing with it.

Consequently, I used your website to get advice on how to proceed. Imoinvest responded on your website see other threads :

Despite the contents of the response from Julian Lu - see other threads - in which I was told the TVA was being progressed I have just received the first contact letter from the Accountant dated the 24th November 2005 that is six months after the completion of the sale of the property in May 2005. It is evident from this correspondence that the accountants have not even applied for the TVA as they had not even received a copy of the countersigned Commercial Lease . The accountant had asked and expected to get a copy of this lease direct from IMOINVEST but IMOINVEST could not or would not provide them with a copy and asked them to come direct to us

This was despite IMOINVEST confirming on your website that they were and would continue to facilitate this refund within the time scale given. We were given the false impression on this website that the application for the refund had in fact been sent and was being dealt with by the French Tax Office and reminded that the Tax Office does not work to time frames laid down by organisations nor individuals such as me. However, I would expect the tax office to work to time frames based on the age of an application and prioritised by dealing with the earliest received first. However, in my case the Accountants -six months after the purchase of the property - has not even received the Lease which would be required by the Tax Office to progress the refund..

As I said already I have found IMOINVEST to be unprofessional and incompetent and this just proves the point anna smith38737.8821875
