Incorrect Mortgage Rate

Hi there

Just wondering if anyone could give me some advice.

Having recently reviewed our original mortgage documents from 2006 for a leaseback in the South of France, I was horrified to realise that we are paying a fixed rate of 4.35% + tax instead of the 3.9% rate we agreed to at the time. I have the original e-mail outlining the 3.9% but unfortunately we signed the mortgage paperwork for 4.35%. The confusion for me I think was that 4.35% was the exact promised return from the management company running the leaseback and so I did not spot the error.

With 4 years passed, do I have any recourse against the brokers Imoinvest or is it too late as the documents were signed off at the higher rate.

Our building society have written to us to say that since May 2008 they
had wrongly been taking the incorrect interest on our mortgage. Our
fixed rate ended in May 2008 and instead of them reverting the payment
back to the variaBLE RATE OF 5.35% They have incorrectly been taking the
previous fixed rate of 5.04% They have written to advise that they have
now increased our direct debit by approx £25 per month to cover the
underpayment. Can they do this?

Imoinvest still exist with an office in Paris, you can Google them and ask for a compensation I guess
