Any sign of legal action

Is there anyone on this forum who has personal experience of being actively pursued in Ireland/Uk or anywhere else by either a French financial institution or the French Government after defaulting on a mortgage on the one of these multiple leaseback scams which have caused so many of us such enormous stress over the last several years ?. 

It has been obvious for several years now that this has been an organised financial scam at multiple levels. Many of us feel that we have have been set and robbed by a variety of agencies. We, collectively, have been scared about re-possession, legal action in our home countries etc etc even though we are the real victims.  I would like to hear from anyone who has been served with legal action in their home country as a result of this debacle.  

From my point of view, I have begun legal action in France with the aim of cancelling the sale of my "investment" which was obviously flawed &Amis-sold from day 1.

I am in a similiar situation. The bank have just demanded the repayment in full of my mortgage. I simply caouldn't meet the mortgage payments. I hadn't intended contesting the repossession but I'm wondering if I don't would it make it easier for them to enforce a judgement here in Ireland. 

Anyone have any advice?

I have been served with a repossesion order i  just  couldn`t take the pressure anymore so let my mortgage  go into arrears. As of yet since i got the notice i havent heard anymore. I`m still waiting for them  to come after me for whatever balance is owned but i have been told that even if it went to court all i can do is make an offer to pay it  monthly  and by law they have to accept it but until then thats only hearsay. Other than that i have stopped thinking about it as i lost to  much sleep over it.

 

#Worried2 Regarding the legal action you are taking against the agencies involved in the leaseback fiasco, I am interested in the nature of the action you are taking (e.g., formal name - what is the basis you are citing to underlie the legal redress you are seeking) and how you managed to get together, if that is the case, with the other 15 people who are also taking legal action.  I think we have definitely been shafted by everyone involved, and wish I had seen posts by people in Askaboutmoney.com who had expressed extreme reservations regarding investing in these obviously untrustworthy schemes, before I invested.  Everyone I consulted thought it a marvellous idea - unfortunately!  It's possible banks may be a little less aggressive and more open to negotiating with clients/restructuring loans if there was some legal redress against them, as opposed to all legal safeguards being on the side of financial institutions and management companies, and against the individual investor who appears to have no legal safeguard whatsoever.

 

Any advice you can offer would be appreciated.  Thanks.

Very hard to discuss comprehensively in/on this forum so perhaps give me your email address & we can communicate more thoroughly.

In essence, our cases have been lodged in court (at Norbonne) naming the Irish promoter, the Irish solicitor who took responsibility for witnessing documentation, the developer, the Notaire & the French bank as defendants. The basis of the case is that rents could not be guaranteed in investments such as this for a multitude of reasons & that all parties namedwere aware of this (or should have been). The court has been requested to authorise the cancellation of the sale (with monies being paid back to investors) along with compensation for distress & mis-selling.

Cases are lodged separately as there are differences between all of us but at the same court to build precedent.  It's anticipated that financial institutions will attempt to re-possess these properties & these actions are designed to counter this.  

There are no guarantees of success obviously but if, like me, you are certain you were mis-sold/defrauded what choice do you have ??.

I came across another situation during the week.  Type "the  Appollonia Case"  into Google & read the associated article.  It will make your blood boil & shows that this situation is a national scandal for France that has yet to be (but will) blown wide open ultimately. Not withstanding all that happened in France over the lat 10 days, it's hard not to draw the conclusion that there is much rotten about the country.

 

 

 

hi, see my response today under "formal notice to pay" thread.  yes, i got demands to pay mortgage in full from the bank, got legal letters etc. and engaged a good UK/FRENCH company who took on my case for a one sum retainer. I haven't looked back in terms of advice.   it is now sold and the bank have instructed me in writing that they will pursue me for the balance in Ireland when the monies from the auction come through to them.

therefore to decrease risk here we are blocking this move under european law in French court.

Hi everyone , i have been watching this website for a while and have had to keep quiet until  now PLEASE READ THIS TRUST ME IT WILL BE WORTH IT !!! 

Ok here goes I will try to keep it as short as possible .... My ex husband and I bought a " luxury serviced appartment " in VILLA MURANO also known as HOTEL MURANO , MURANO RESORT ALSO KNOWN NOW AS STREETS HOTEL ??? Any way we suffered like all of you loss of rent , non payment of rent , problems with BARFIMMO Barclays finance immobilier no help from them no support just foreclosure and later resulting in the seizing and selling at auction for a derisory sum less than half the market value of our INVESTMENT " 

WE WERE NEVER MADE AWARE OF THE FACT THAT WE PURCHASED 2 HOTEL BEDROOMS !!!!!!! We suffered gross fraud miselling and many other issues - we are not wealthy and this was our pension life savings etc . We decided to take these people to the high court , we have legally seized their assets, and purchased a charge over a mortgage in the directors name and after 5 years we are approaching judgement day ! Let me just tell you we have THE best lawyer who has been amazing , thorough, professional and above all has the highest professional ability and reputation - if you are considering taking legal action these people are the best ... There is no point in using small legal firms you are all thrashing around like small fish in a big pond we are now in the hands along with 4 other co-owners of one of the biggest European law firms who have many many successful cases behind them . 

I pray we will win and DEFEAT these crooks and after 5 years and huge financial burden and enormous stress I cannot stand by and watch these crooks rip off and destroy any more innocent people for us it's **it or bust ... 

The LEASEBACK MODEL must be stopped and after our case I think it will be an explosion of people jumping on the bandwagon ! 

We were MISOLD , MISLEAD, MISINFORMED and LOST EVERYTHING please don't let this happen to anyone else

I posted in Oct '14 and I had made contact with an Irish owner in similar situation who had been in touch with an Irish solicitor who was also helping them.
