Got a nasty surprise today - a Taxe d'habitation + Redevance Audivisuelle 2007 request for nearly 800 euros!
I understood that the occupier of a property is liable for the Habitation tax and for my leaseback that would be the tenant or more correctly the management company Suites Etudes. I never received any Habitation tax request for 2006 so I'm assuming it's a mistake and have written to the Centre Des Impots.
I get two weeks use of my leaseback every year so theoretically I suppose I could be liable for 1/26 of the tax bill but this never came up last year.
There's no TV in my appartment either so the Redevance Audiovisuelle demand seems wrong too.
Have any other leaseback owners received similar tax demands?
We got this too and so did at least one other owner. We have sent ours back to the address on the demand, Tres. Pantin, with a letter informing them of Suites Etudes' address, although we did fill in a form earlier in the year giving them the same information! Suggest you send yours back too. As far as we can gather, owners are not responsible for this tax. And we were informed by Suites Etudes last year that there was no TV in the apartment.

I have received these for the last 4 years and send them back every year with the name and address of the Head Tenant(Management Company)but they still keep coming.
I have spoken to my French accountant and he has spoken to the tax office but it dos'nt make any difference.

I used to receive them and kept sending them back. Haven't received any for about 2 years. I have had confirmation from the manager at my leaseback complex that the TV licence is included in the managers budget for running the complex.
I've written to the Centre des Impots and given them the name of my management company to approach for the tax.
Hopefully that's the end of it though maybe not judging by the experiences above!
Hello I am new on this forum but got some experience in the French leaseback as I am a owner of a flat in a Residence de Tourisme in France and also an active member of IRT-investisseurs résidences tourisme and I would like to share my experience and help out.
So let's now move to the subject: the Taxe d'habitation. You SHOULD NOT pay it. It has to be paid by your Gestionnaire/management company. So write a letter (with a copy of this tax form) to your management company asking them to pay their bills and send the copy of this letter and a copy of your leaseback contract/bail commercial to your tax office in France.
Do not pay the TV tax either.
Got an email back from the Centre des Impots saying they will 'Effectuer le degrevement de cette taxe' meaning they will withdraw it.
Result!
We Received this bill also..... Thank god we don't have to pay it.

After receiving this tax d'habitation bill and discovering on here we did not need to pay it we wrote to cdi.beziers@dgi.finances.gouv.fr
They replied asking for copies ofthe bail commercial.(lease agreement/plan)
this is what we got back......i don't understand it. All i know is i do not need to pay this bill. Can you advise what the email below says and add any thoughts and comments????/

locaux imposables.
Par conséquent , les personnes qui donnent des logements meublés en
location saisonnière entrent dans le champ d'application de la taxe dès
lors qu'elles sont réputées en garder la disposition en dehors des périodes
effectives de location . Voir votre contrat avec la société Odalys où il
est mentionné que vous pouvez avoir la jouissance de l’appartement 2
semaines durant l’année . La taxe d’habitation ne s’applique pas dès lors
que l’appartement est destiné exclusivement à la location et que le
propriétaire ne peut en avoir la disposition à quelque période que ce soit
de l’année .

Have you bought your furniture (from Odalys) or do you rent your flat to Odalys "nu" (without the furniture)? It should be written in your leaseback contract.
If your flat is rented "nu" you do not have to pay the Taxe d'Habitation. It should be paid by Odalys.
The guy is here apparently mixing / confusing status. In a Residence de Tourisme when you go to your flat and stay there you are Proprietaire Loueur and you are not considered as a proper owner.
For my flat the cdi sent me "un degrevement", my mgmt company will pay this tax and it has been registered at the tax office to be for the next 7 years.
O.K!!!!, I have received a second Tax d'habitation bill/ demand!!!! does anybody who has a leaseback with 6%return...and 2 weeks a year use have to pay this or not.....Please reply
