Hi y'all,
Does anyone have a property in this development?
It would be great to hear from anyone else on the estate - we could compare notes etc.

Thanks to all for the replies,
I did contact a solicitor who advised me to hire him to take out a 'commandment de payer' which would get them to pay the money they owed and that his services would cost around 600 euros.
I paid this and, after asking me for the money twice ( for which he apologised ) he then said that it would probably be a waste of time issuing the 'commandment' thing.
I said ok and asked for a refund but he would only give me €165 back as he had spent time emailing me for which I was charged €435 and nothing was done to resolve the situation. ( I wish I could have earnt money at that rate whilst I was working! ).
I cannot afford to pay any more money to solicitors as I am having to pay my mortgage and other charges.
So this leaseback scheme has cost me dearly.
Contact the notaire who was overseeing this dodgy deal and gave it the thumbs up
Hi berni
Who was your solicitor and why did he say thre was no point in the command de payer?
Berni
Chances are the company was going bankrupt or insolvent and he saw the CDP as a waste of time. What reason did he give you?
Mutley
Hello Noelle,
I am very glad to hear from another resident - although I do not have much information to offer you.
I have tried in every way to contact Revalis but they continue to ignore me. The next quarters rent is due at the end of June and that will be 6 months without any payment !
I have been taken ill recently and, although I have tried to be patient, may have to hire a lawyer to act on my behalf. Like you, I am not sure what our position is but surely we must be entitled to some rent and/or occupation of our properties.
If anyone knows anything about this situation - or the contact details of a good leaseback bi-lingual lawyer, please let us know.
Best Wishes

Well, it's now July and still no rental payments.
They are still ignoring my letters and emails.
Unless they come back to me in the next week or so, I am forced to hire a lawyer.
What has happened to the much vaunted 'commandment de payer' that is supposed to ensure that either the mgt company pays up or else gets out of your property?
Hiya Mutley & strider,
The solicitor was named Cordiez and yes, he did think that Revalis was going bankrupt or insolvent and he saw the CDP as a waste of time.
I wish he had told me this ( rather than the opposite ) before he took my money.
I have since been down to our property and everyone there thinks that Revalis have gone bankrupt yet they are still advertising holiday rentals all over France.
Still trying to get the year's rent they owe me - next stage is to contact the French media.

Hi Berni,
You should contact Revalis at their head office in La Rochelle.
The number is 0033546074863.
There is a lady there called Sara who speaks good English and hope fully she
will be able to help you.Let me know if I can be of help to you.At the
moment my rental payments are up to date, but we will see what happens
next month when Q1 is due.
Regards
Sean
Hello Sean,
Thanks for the information. I will give them a ring after Easter when it will be 6 months ( 2 quarters ) without payment.
A friend, who speaks French, has managed to get throught to their office in the South but they say they cannot pay until they have established a “ligne
bancaire” whatever that is. They would not elaborate and my friend said the lady she spoke to was very stressed and said she was 'in the middle" of all this and had hundreds of people asking about their properties. She also said that she had been instructed not to communicate - hence the lack of response to my half-dozen emails.
Do you know what happens if they stop paying?
Thanks again for the phone number.
cheers

Just in case anyone is interested...
Revalis Ever have finally written to me to say that if I want them to continue administrating ( i.e. if I am to get any money at all ) then I have to accept a 30% reduction in thre rental payments.
This sounds very unfair but what can we do?

Hello JuanAzur,
I have recently hired a solicitor to issue a 'commandment de payer'. Although the 30 days which they have been given to pay the arrears is not yet up they have not been in touch. No problem getting them out - they have already abandoned the property despite having another 3 years to go on the leaseback agreement ! Apparently I must find another leaseback management company to take over the running of the place.
The trouble is they have not given me the keys so I have no access to the property. A couple of years ago I had a buyer but this lack of access caused the sale to fall through.
The worst thing is I am still paying a mortgage, 'general charges' for the upkeep of the grounds, taxes etc. with no rent coming in and no access to my property.
The whole thing is a nightmare made worse by me having a stroke a few years ago and as a result losing my job. This year I have also been diagnosed with cancer yet despite begging letters (asking for an explanation of what is going on and how to proceed) to all concerned I never get a reply.
Without an income ( except a small pension ) I cannot afford to keep paying all these charges.
Any advice would be much appreciated.
cheers

I am very sorry to hear about your circumstances, especially your health. When the the 30 days are up baliffs will call to recover the rent. After this period you can then use baliffs to gain access to your property - I am not sure how long after you have to wait to do that. I have not had direct experience of this but perhaps you should contact Mutley on here. By the way, these French crooks care about nobody, and don't expect anything from them.
Berni
Sorry to hear your bad news. Firstly, who is your mortgage with and secondly is this the primary management comnpany we are talking about (you have not signed a new lease with a management company since the purchase)?
Mutley
From experience (bad experience with another residence) I can tell you that individual approaches are ineffective. You need to set up an association with other owners so you can seek advice from a solicitor as to what to do from this point onwards. A small group of motivated people could lead this action and also seek expressions of interest from potential lessees. Good luck. I'm happy to contribute further advice through the forum.
Hi,
I too am an owner of a property at Domaine de la plage. I
have received a letter also stating that they are reducing
the rent by 30%. Does anyone know what our position is
after the 9 year lease is up? Can we agree not to lease the
property to the management company after the 9 years? I am
not sure what prtion of the development is for leaseback.
Regards,
Noelle
