Twined Cottage

Hi Seamus,

You have lots of experience of french lease back so I was thinking you may be able to give some advice on my situation with my management company,

I bought a cottage from Pierre&Vacance at Domaine du Bois des Harcholins, and entered a 9 year lease with them which they honoured,

However when I inspected my cottage recently its not as it should be, it been joined with my neighbour, so instead of owning a two bed cottage with kitchen/livingroom/jacuzzi, it appears I own a share in a four bedroom cottage,

The nine year lease is now up and has been legally terminated by P&V and Im refusing to sign their new 11 year lease as I believe they have broken our original sales contract, the new lease also has included very high refurb costs and a slight decrease in rent.

I would like your thoughts and advice on what I should do and if you could point me in the direction of a reputable solicitor so I could get french legal advice,

Similar situation, same location. We couldn’t book our 6 person cottage as it’s made into a 12.Not ideal of course as we hoped to vacation in our own place. However, they have a business model and apparently need that type of accommodation. Additionally they have assured me twice that they will rectify the internal wall at their cost if sold and new owner declines the lease. I can provide email text if you wish although perhaps they have communicated such already? At the end of the day it’s an investment for us and that’s the form they use to pays the bills. Of course it would have been nice to have been informed of such a change but we take the emotion out of it and the rent pays down the mortgage. Somewhat.  From our perspective they have always paid up, 9 years done now, (reduced rental of course is a different topic). With 11 more perhaps many of us will be without mortgage and can be better placed to put an end to their strong arm tactics and high prices, particularly if the association stays together.What’s the legal struggle worth to you if they'll return it to you whole anyway? Hope that helps, best of luck.Declan

What Im trying to do is establish the legal situation with the sales contract, P&V have sold me something which is not in the sales contract and I want to test this under french law and would be seeking for the sales contract to be put aside and sales price repaid to me

Are you in contact with https://intranet.acd3f.com/ ? If you aren't aware of it (I wasn't for a while) it's a form of owners association. They were the ones that informed me my cottage could be twinned. If you aren't in contact with them they may be able to advise you. They have also been negotiating new leases.

Its just getting a solicitor who speaks english, knows french law and is already dealing with leaseback issues is a problem sourcing

I am not a French solicitor, but I am quite sure that you are in the eyes of the law the feehold owner of the property and as such a tenant cannot structurally change your freehold property in this way. You need to go to a solicitor.
