Eurogroup Lease Termination

We are now considering terminating our lease with Eurogroup.

Can anyone recommend an English speaking lawyer who has experience in this area?

We used the following lawyer to get out of our lease with Eurogroup:

Loïc Raboteau, MBA

International Legal Advisor & Director

Can I ask at which Eurogroup site you are an owner?

I may have a recommendation for a lawyer.

I am also looking for a lawyer who has expertise in dealing with French Leaseback properties. I would much appreciate getting a recommendation from someone. Many thanks.

Incidentally. may I take this opportunity to ask a question here? Is there a law, in the European Union or in France, that says something whether or not ONE owner (an individual or a corporation) can own MORE than 50% of the UNITS in a Leaseback property? This is along the lines of preventing MONOPOLISTIC practices and to prevent one owner from dictating the policies governing the running of the property. Any relevant comment would be appreciated. Thank you.

www.goethe-avocats.fr have been looking after a number of different cases in France lately and seem to be everywhere now.

With solicitor, make sure to have a clear understanding of the contract you are signing up with them and have a clear understanding of the costs. Surprises can happen with any solicitor.

Regards,

If it's still pertinent I have been recommended to look at Jacques Gobert, an avocat based in Marseille with offices in Paris. Appears to be a specialist in Commercial and Property law.

I'm trying to break lease at the next renewal. Solicitor has been writing repeatedly to Eurogroup to ask for a copy of the lease, with no success.

Good morning,

In the past I have managed to get answers from their legal department by using the following email address: cbertojo@eurogroup-vacances.com

Hi, I have received a termination request from EG for my apartment at the Hotel Ibiza Les Deux Alpes - Can you please advise how you managed your apartment after the termination? Did EG request any money to access shared resources at your complex? The Hotel Ibiza has a swimming pool, gym, reception, restaurant, bar, games room. EG will still manage the hotel the hotel for the majority of the leaseback apartments but would they try to charge me or my guests access to these resources? I receive no response to any request I send to EG plus they also owe my six months rent....

We are also considering terminating the lease with MV on a chalet in Alpe d'Huez. MV are coming back to us with an extortionate amount of eviction fee. We are debating the value of waiting, especially with Covid keeping the resorts closed...

If anyone has successfully terminated their "bail commercial" with MV, we would love to hear from them.

Thank you

Do you know what rent they earn on your apartments approx per year or have you access to turnover figure for resort so you could do guesstimate? If you went ahead with eviction but didnt pay the eviction indemnity then eviction would have to be settled at a legal hearing at some stage.
Judge at hearing would likely ask you to pay 2 years of rent as indemnity(compensation). Thats 2 years of rental earnings operator was making on your apartment. Also possible if it took a 2 year or so to get to hearing that you could get lawyer to argue that those extra year can be offset against indemnity payment.
A chat with a lawyer may be sueful but if you want lease to end then going ahead with conge may be only option but with likehood of paying indemnity. There have been cases where indemnity was set to zero but prob difficult to win.
Again a lawyer would know more but think it is common for operator to initiually ask for a large amount as they know you wont pay but so ot will have to go to an eviction hearing - Gain for operator is that can take a few years so they can earn more rent in interim.

The link below prob explains better than above and is at the Blog section on this website
