CDP for free

For information when you serve a CDP through a bailiff , all the legal fee are entirely recoverable by you .

Once your rental company will pay your rent ,they will also have to pay the legal fee...

So do not hesitate a minute to get your money back !!!

Contact a bailiff ....Most of them speak english !!!

It's not that easy. The management company will be required to pay the baliff's fee only if they actually pay the rent also. The reason many people are in this boat is bceause management companies don't pay rent. If you don't speak french this is not so easy. For peace of mind I'd rather pay Seamus the €50 to have it done properly. There's nothing worise than paying €150 and the management company can ignore it on a legal technicality because you did something wrong. Seamus' service obviously works if it has been used by a number of people before.

I do NOT speak French at all....However I get all my money back thanks to the bailiff.

Why do you want to pay 50€ on top of the legal fee especially if you are not even sure to get your payment from the rental company??

 

 

 

 

 

 

How many times have you done this? Do you think all baliffs in France can work in fluent English?

I said most of them...You just have to check first that they speak english....That is very easy to find out on internet !!

 

So how do I actually find a bailiff?

So I have to assume you actually have not yet done a CDP, which is fine. The £50 fee charged on this site seems very low actually - I contacted a solicitor about it yesterday and he was charging 260 EUR! I was actually going to use this site's service anyway because I find the whole thing a bit daunting. But I was just curious about your experience - or "lack of" from what I have to assume.

Yes and how do you know 'most of them' speak English? Have you spoken to all of them in order to make this pronouncement?

I did it 2 times and it's always the same documents that is requested by the bailiff (all your personal details , the copy of your lease ,the amount of rental due by the company ..)

We dealt by email all the time and I never had any problem with the language !

How to find a bailiff ? Just search on the web "huissier de justice" and enter the town where the head office of your letting agency is !

Then contact them by email !!!It's much more easier for everyone especially when you don't speak the language.

For information I used Mr Plantaz Laurent in Chambery and Mr Cordiez Fabien in Aix la provence for an other proeprty of mine.

Both were extremly helpful and as I said before I did get ALL my money back !!

 

 

 

For information Gord the CDP through this site is not £50 !!!That's what I thought at the start but it isn't !

The £50 is a fee that you pay on top of the legacy fee !!!!

I am so glad you have replied. Yes I know the £50 is an admin fee to prepare the CDP. But I think you should be aware, Fabien Cordiez is not a bailiff - he is a solicitor! So I think if you check your invoices you will find you have paid him for the admin. And you have also paid for the bailiff separately. I know this because a colleague of mine has also used him for the CDP. But thank you for the clarification.

It's nothing to do with anger, it's about highlighting inaccurate information.

 

You cannot say most bailiffs speak English - that is inaccurate.

You have then sent 4 CDPs 2 by bailiffs and 2 by solicitors - that's 4 in total.

Seamus does not charge any "legacy fee". He only charges £50 for the admin. The "legacy fee" (which is the wrong expression to use) is the bailiff fee. A bailiff (not a solicitor) must deliver the CDP by hand to the management company.

Once again we have more misinformation from mariefit. It's ironic that we complain about French crooks giving us misinformation regarding leaseback yet we have members of this forum doing the same. Séamus has provided an excellent resource here in the form of a forum - it allows leaseback owners to conatct each other and there is no other resource like it for English speaking owners. It is free and is maintained by Seamus at no cost to us and yet there are some people knocking him for charging a fee for a CDP at a fraction of what a solicitor charges.
