Murano Resort Paris

13 October 2008

While this leaseback has behaved reasonably well for the past few years with payments being made with a consistent level of arrears.

In the last 6 months things have deteriorated are there other owners out there from Murano with similar experiences.?

How do you get on for discounts at the hotel ? I never do very well.

I recieved payment in June for significant arrears though using a French solicitor ( F.C.)to issue a commandment. So they were obviously still paying at that stage but I have not recieved anything since then. I hope to visit them shortly to see what is happening on the ground. Is the restaurant still busy etc.

Hi Ray

The bailiffs whom I had instructed have advised that Sarl Murano have settled those sums
which we claimed through the 'Commandement de payer' served on 17 June.
This should normally also include the bailiff's fees.

As soon as I receive the bailiffs' cheque, I will forward the same to you.

Kind regards,

Fabien

Hi

Just picked up your thread. I have been through the mill with another leaseback residence. I am now seeing a resolution with payments having been restored after 9 months. The process is complex and can be time consuming. Please contact me directly, if you would like to learn from my experiences.

Recieved my registered post today from Hotels de Paris (management company at Murano) They are proposing a 10 % reduction in payments from Jan. 2009 with these Payments to recommence in July2010. Has that been proposed for Le Kube ? Any comments ?

I own an apartment at Murano Urban Resort. I had always had some problems in cashing the rent in due time, but at least was always paid until the beginning of 2009.

I contacted a solicitor in <?:namespace prefix = st1 ns = "urn:schemas-microsoft-com:office:smarttags" />Paris that managed to collect the Q2, Q3 and Q4 arrears from 2008, last April-May.

Since them, in spite of having launched an “injoction de payer” that is still pending of a decision of the Commercial Court, and having received a (friendly?) letter from Murano acknowledging the debt and promising subsequent payments, I have not been paid the last two quarterly instalments, i.e. Q1 and Q2 2009, due April 30 and July 31 respectively, not to mention Q3 2009 that will be prescribing in a few days.

I read in this forum reports from other owners in a similar situation from Murano as well from Kubus, that is managed by the same company and I will be willing to join efforts with other owners in view of a combined action.

The proper course of action consists in issuing a 'commandement de payer', not an injunction.

I already act for several owners in relation to Murano (Le Kube). You are welcome to join the group. Here is my email address: fabien.cordiez@solicitor.fr

Apparently, some professionals advertising on this site arrange this at
no extra cost! Feel free to contact too them for further details.

Ray,

I own an apartment in Le Kube, Paris. As far as I know, this is related to Murano Resort Paris. My tenant is "Les Hotels de Paris". I have always had problems but at least the rent was always paid - until now. Last payment due January 2009. I have an agent in Paris to collect rent but this is not working. Agent went so far as to send out a bailiff, but to no avail.

The only way is to organise fellow-owners. Are you interested?

Yes the management company is the same , I have sent pm with contact details.

Beware Murano and Hotels de Paris. Both controlled by a Patrick Machefert who runs the big Paris stock-exchange quoted Les Hotels de

Paris SA as criminal enterprise for his own benefit and not that of his landlords (us) or his shareholders.  Uses every possible unsavoury

tactic to gouge the company of money (he claims HdP runs at a loss) and us out of our investments and our rents. He is despised by HdP's

staff and senior management. He doesn't pay rent and then offers to buy the apartments/rooms at ridiculously low prices from those owners

who cannot afford to cover their mortgages and/or afford to take him to court over the long term. M. Machefert belongs in prison but this

seems unlikely in the cozy world of the Parisian courts. If anyone wants or has more info or background on Mr Machefert or wants

to discuss this let me have your phone no and I will be in contact. Good luck to all!
