Termination of lease by Odalys (Bastides de Grimaud)

Hi all, just received formal bailiff notice in duplicate from Odalys advising lease will cease on 31st December when 6 months notice expired. There is (allegedly) an offer on the table from another company at 30% less rent which I will NOT be accepting largely due to the sound advice received from fellow forum members and Seamus in particular.  I belive I can from 1/1/18 either use it myself or sell it privately but will have to pay back proportionate VAT.  However, I'm considering continuing to let it on my own for holidays/short term lets so the VAY doesn't have to be re-paid.  Could someone kindly remind me of the four things/services offered which make it qualify as a holiday let of which I understand one has to offer 3 of them.  Thanks, Iain

 

 

3 of the 4 on my yearly contract are 

  • Reception of tourists and the delivery of keys (meet and greet)
  • Supply of linen and sheets
  • Cleaning of apartments on a regular basis on request

 Think the 4th service is breakfast. I've gone through contracts with 2 operators. Just forward draft of contract to your accountant who will pick up any gaps.  You can just use an operator to provide services and do rentals yourself or operator could also manage rentals for you. airbnb tripadvisor homeaway.co.uk useful. You could also use as holiday home but need contract as proof that your apartment is available for rent. 

I too have just been served notice by odalys to terminate my lease with 6 months notice. I am owed 18 months rent and have had no response to a CDP served in March. The bailiffs are now applying to the courts to be able to seize assets in lieu of payment. I too will be glad to end my association with odalys and hopefully rent the property myself

You're very lucky! I wish our Management Company  (Madame Vacances) would terminate our lease! Instead they are screwing as much money as they possibly can from us owners who would like to leave. This seems to be their number one business priority, far ahead of providing excellent holidays to their clients. Even if you don't get paid some rental money due, I would suggest that you are going to be much better off than if you were faced with the indemnity that MV want from us to leave.

Make sure you get proper advice about what you need to provide to remain within the TVA scheme, you may think you have done it ok but the French authorities may not agree!
